RESOLUTION NO. 03-14

SERIES OF 2014

            WHEREAS, a CLAIMING RACE is a race in which any of the horses entered may be purchased (claimed) out of the race by any person who is eligible to claim a horse at the meeting;

            WHEREAS, a CLAIMING RACE is an innovative way for horse owners and trainers to find another place for their horses to be marketed or sold;

            WHEREAS, a CLAIMING RACE is a way to encourage/ entice new players in the horse racing industry to own horses;

           

            NOW THEREFORE RESOLVED, that a CLAIMING RACE be held in the Philippines and for that purpose the Philippine Racing Commission hereby issues and promulgates the RULES AND REGULATIONS to govern such CLAIMING RACE contained in the attached ANNEX” A” and made an integral part of this resolution

CLAIMING RACE

(EXCLUSIVE FOR THE PHILIPPINES)

  • A CLAIMING RACE is a race in which any of the horses entered may be claimed (purchased) out of the race by any person who is eligible and who has no impediment to claim a horse at the meeting.  Claiming race is designed for several price levels / groupings:
    • The Bottom Level
    • The Mid-Level
    • The High Level
  • CLAIMING RACE is an innovative and attractive way for Horseowners and Trainers to find another place for their horses to be marketed.
  • CLAIMING RACES are a way to encourage / entice new players in the horse racing industry
    • The success of CLAIMING RACES are dependent on a sustainable media exposure (print write ups, TV discussions and social media such as Facebook, Twitter, Instagram etc.) in this connection the sponsoring organization and the racing clubs shall implement the above mentioned promotion.
  • CLAIMING RACES will be treated as “Stakes Race”

I.  WHO ARE ELIGIBLE TO CLAIM A HORSE?

a. A licensed horseowner, corporation, partnership or syndicated groups and / or trainer acting as their agent.

b. Any horse enthusiast who is of legal age.

  1. Any claimant who wants to claim a horse must drop in a locked deposit box in possession of “Treasurer” of the Sponsoring Association the equivalent of the claiming price plus three percent (3%) administration fee by way of any acceptable mode of payments (manager’s check, personal check or cash) no later than thirty (30) minutes prior to the scheduled claiming race.  This will include filled-up “Claiming Form” both placed in a sealed envelope.
  2. The lock deposit box will be brought by the “Treasurer” of the Sponsoring Association to the Chairman of the Stewards who will then open immediately after parade of horse of the CLAIMING RACE.
  3. The claimant who has claimed the horse automatically becomes its owner once the gate opens. 
  • However, if the horse becomes injured or suffers bilateral epistaxis (blow) or died during the course of the race, that the sales will be considered null and void.
  • However, the prize money earned in the race goes to the original owner who entered him in the race. 
  • The prize money and or any incentive will go to the original owner.

c.  The Chief Steward will inform the Paddock Steward that a particular horse was claimed.  The Paddock Steward will have the tag “CLAIMED” in the halter of the horse claimed before allowing it to enter the paddock for the Jockeys weigh-in (so that the public may know) by announcement.

d.  The Club should prepare “Claim Tags” equivalent to the number of horses entered in the Claiming Race.

  1. If more than one person has put in a claim for the same horse, they draw lots supervised by the responsible officer of the association.  The person who wins the draw lot becomes the owner of the claimed horse.
  2. The Groom of the CLAIMED horse will immediately surrender the horse including its halters and lead rope to the groom of the successful claimant.  CLAIMED HORSE must have a NEW TRAINER and a NEW STABLE.
  3. The new owner has to legitimize owner’s registration by formally applying registration with the Commission with an endorsement from any of the Horseowners Organization.

II.   WHO ARE NOT ELIGIBLE TO CLAIM A HORSE?

  1. A horseowner who participated in a claiming race is disqualified from claiming the same horse directly or indirectly.
  2. Relatives and business partner/s of the owner of a horse entered for a CLAIM RACE are disqualified to claim the same horse.

III.  RESPONSIBILITIES OF THE HORSEOWNER WHO WANTS TO NOMINATE HIS HORSE IN A CLAIMING RACE:

  1. The horseowner will execute a deed of declaration stating that the horse nominated is sound for racing and not a roarer as certified by a licensed veterinarian nominated by the sponsoring Club and accredited by PHILRACOM;
  1. The horseowner who enters his horse in a claiming race must execute a final deed of sale and delivers all documents to the successful claimant within ten (10)  calendar days after the racemeet;
  1. The horseowner who enters his horse in a claiming race will pay all taxes to the government once a sale is consummated.

IV.  MECHANICS:

  1. A CLAIM RACE will be treated as a stake race as far as observing the nomination, declaration dates;
  2. Horses entered in a claiming race will appear in all the racing programs to be initiated by the Sponsoring Association and assisted by the Racing Club where the Claiming Race will be held.  This is to ensure that only interested  enthusiasts may know,  inspect if they wish to assess a particular horse listed;
  3. For this purpose the nomination and declaration fees are MINIMAL (i.e. ₱ 100.00 - ₱200.00 only.

NOTE:

  • As an incentive, the successful claimed horses will be allowed to join the 2014 PHILTOBO Special Races free of charge for the nomination / declaration fees.
